On Memorial Day, a sitting U.S. senator was pepper-sprayed by federal immigration agents outside a New Jersey detention facility where hundreds of migrants were on hunger strike — and four detainees escaped amid the chaos.
Story Highlights
- Senator Andy Kim (D-NJ) was struck by pepper spray after stepping between Immigration and Customs Enforcement (ICE) agents and anti-ICE protesters outside Delaney Hall detention facility in Newark on May 25, 2026.
- Hundreds of migrants inside Delaney Hall were reportedly on a hunger strike, while protesters outside clashed with federal agents, prompting ICE to suspend facility visitation.
- Four detainees went unaccounted for following the unrest, according to law enforcement officials.
- The Department of Homeland Security (DHS) accused protesters of obstructing and assaulting law enforcement, while critics condemned the use of chemical agents against elected officials and demonstrators.
Memorial Day Standoff at Delaney Hall
Senator Andy Kim skipped traditional Memorial Day observances to travel to Delaney Hall, a privately operated Immigration and Customs Enforcement (ICE) detention facility in Newark, New Jersey, where a large protest had formed. According to reporting from InsiderNJ, masked ICE agents confronted protesters outside the facility, and video captured by PIX11 News documented the escalation. Kim reportedly attempted to de-escalate tensions by urging protesters to step back before being struck by pepper spray, sustaining an injury to his hand. [8]
Senator Kim and fellow New Jersey Senator Cory Booker released a joint statement condemning what they described as an aggressive federal response. The senators characterized the ICE activity in Newark as an escalatory raid and called for accountability. Their statement reflected the broader Democratic position that the Trump administration’s immigration enforcement operations have been conducted with excessive and indiscriminate force — a charge the administration flatly rejects. [7]
DHS Says Protesters Were the Aggressors
DHS spokesperson Tricia McLaughlin stated that protesters were “obstructing and assaulting law enforcement” and that the facility suspended visitation to protect staff and visitors. DHS also denied claims of inadequate medical care being provided to detainees inside the facility. Fox 5 New York reported that DHS accused some demonstrators of throwing objects and slashing a vehicle tire, framing the use of pepper spray as a necessary crowd-control measure rather than an escalation. [6]
The situation inside Delaney Hall added urgency to the confrontation. Hundreds of detainees were reportedly participating in a hunger strike to protest conditions within the facility. The combination of internal unrest and an increasingly volatile crowd outside created a volatile environment that ultimately resulted in four detainees going unaccounted for, according to law enforcement officials. Whether those individuals escaped or were otherwise displaced during the chaos remained under investigation. [6]
A Pattern That Keeps Repeating
The Newark confrontation is not an isolated event. In December 2025, Arizona Representative Adelita Grijalva reported being pepper-sprayed by border agents while seeking information during an immigration raid in Tucson. Grijalva said she was attempting to gather answers from federal agents when she was hit. DHS responded to that incident as well, defending its agents’ conduct and characterizing the congresswoman’s presence as an interference with enforcement operations. [5]

Senator Dick Durbin of Illinois, the ranking member of the Senate Judiciary Committee, separately condemned what he described as the Trump administration’s “Operation Midway Blitz,” citing an incident in which ICE agents pepper-sprayed a U.S. citizen and his one-year-old daughter. Durbin took to the Senate floor to denounce the enforcement campaign, arguing that the administration’s tactics have moved beyond targeting undocumented individuals and are now affecting American citizens caught in proximity to enforcement actions. [3]
Competing Narratives, Unresolved Facts
What makes these confrontations so difficult to adjudicate is that the public record at the time of each incident is almost entirely composed of political statements and journalistic accounts, with body-worn camera footage, official incident reports, and any independent review typically arriving much later — if at all. Both sides have clear incentives to shape the narrative quickly. ICE and DHS need to defend enforcement authority; Democratic lawmakers need to demonstrate opposition to the administration’s immigration posture. [6] [8]
For Americans across the political spectrum who are already skeptical of government institutions, scenes like the one outside Delaney Hall reinforce a troubling question: when federal agents deploy chemical agents against elected members of Congress and ordinary protesters — regardless of the provocation — who exactly is being protected, and who is being controlled? That question does not have a partisan answer, and it deserves one that goes beyond press releases from either side.

KILL THE protestors
The democrats need to knock it off! Let
ICE do its job! Congressional “leaders”??? What I see are a bunch of really uninformed people trying to make names for themselves rather than trying to work TOGETHER to make this country even greater than it is. Knock it off!
Back all but one defenders deep into the facility. Leave one (possibly unarmed) female guard at the entrance. Let them come deep inside while yelling, “you are trespassing on a federal facility, you are under arrest, stop resisting” let them aid inmate escapes. Then close the gate and arrest them all. Ignore the mob outside the facility.
This man needs to be removed from congress!!!!!!!
DS dem kim got what he deserved by INTERFERRING WITH THE LEGAL DUTIES OF A FEDERAL ENFORCEMENT OFFICER—NO DAM ELECTED OFFICIAL HAS THE RIGHT TO INTERFERE!!!!!!
I can’t stomach it anymore. ICE needs to crack skulls and much more and start with the screaming krat reps who get in their way.
What the hell is that man with his one year daughter doing there. He should be put in jail for endangerment of the one year old child.
Oh my!! He rejected honoring our fallen soldiers on Memorial Day to stand up and fight for noncitizens. He is an embarrassment to America. He should be stripped of all rights to serve in a government position.
